Acceptance of Terms
By using our products, you agree to our Terms of Service.
The following terminology applies to these Terms of Service, Privacy Policy, any Disclaimer Notices, and all Agreements: “Client”, “You” and “Your” refers to you, the person logging on to this website and compliant with the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to Code Snippets B.V. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of the provision of the Company’s stated services, in accordance with and subject to the prevailing law of the Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they are taken as interchangeable and, therefore, as referring to the same.
The services that we provide to you are subject to the following Terms of service ("TOS"). We reserve the right to update and modify the TOS at any time without notice to you. The most current version of the TOS can be reviewed by clicking on the "Terms of Service" hyperlink located at the bottom of our web pages. When we make updates to the TOS, we will update the date at the top of this page. By using the website after a new version of the TOS has been posted, you agree to the terms of such a new version.
Description of Services
Code Snippets Cloud is a set of related websites, software, and web-based applications for users to create, store and publicly share user-generated pieces of code content (referred to herein as the “User-Generated Code Snippets”).
We welcome and invite you to join and participate in the Code Snippets Cloud Network hereby referred to as the “Cloud”. Like all communities, we ask that you participate in a manner that respects your fellow community members. To that end, we provide you with these terms of service to advise you of the legal obligations you assume when you engage with the cloud community or otherwise access or use the cloud for any services provided on the cloud hereby referred to as the “Services”.
Age Restriction
You must be at least 16 years old to access or use the Cloud or Services, including, without limitation, to complete a Code Snippets Cloud Account Registration. By accessing or using the Services or the Network in any manner, you represent and warrant that you are at least 16 years of age. If you are under 16 years old, you may not, under any circumstances or for any reason, access or use the Services or Network in any manner, and may not provide any personal information to or on the Services or Network (including, for example, a name, address, telephone number or email address).
Privacy and Protection of Personal Information
Review the Privacy Policy relating to the collection and use of your personal data.
Content
All content included in or made available through the Services, such as text, graphics, logos, icons, images, sounds, music, digital downloads, data compilation, software, and documents, is the exclusive property of Code Snippets B.V. and is protected by the various applicable trade dress, copyright, trademark, patent, and other intellectual property and unfair competition laws in the United States and internationally (collectively, "Content"). All rights not expressly granted to you in this TOS are reserved and retained by Code Snippets B.V.
User Obligations
To access some of the Cloud features, you will need to register for an account as an individual and consent to these Terms. If you do not consent to these Terms, We reserve the right to refuse, suspend or terminate your account.
You are solely responsible for ensuring that your account registration is complete and remains up to date. You have the right to discontinue the use of, or terminate, your account whenever you like, and subject to our Privacy Policy, control the use and sharing of your account information. Please note that any content or information you share publicly is governed by the terms described below in the section titled “Content Permissions, Restrictions, and Creative Commons Licensing,” and you should be aware that once you place content in the public sphere, you willingly give up some rights and control over such content.
Code Snippets Cloud is also an online community, and we expect you to treat each member of the community with respect. We reserve the right to pause or terminate your account if you engage in disruptive, abusive, or nefarious behavior.
You are solely responsible for obtaining and maintaining any equipment or ancillary services needed to connect to or access the Cloud or otherwise use the Services, including, without limitation, modems, hardware, software, and long-distance or local telephone service. You are solely responsible for ensuring that such equipment or ancillary services are compatible with the Services and Cloud.
You agree to notify Code Snippets immediately of any unauthorized use of your account or any other breach of security. Code Snippets will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Code Snippets or another party due to someone else using your account or password. You may not use anyone else's account at any time without the permission of the account holder.
Access to the Cloud Network
Any registered user (see user obligations) is welcome and encouraged to participate in submitting code snippets, comments, and questions and to share their knowledge with the cloud community, if they comply with the obligations set forth in these terms and to the extent that use of the cloud does not conflict with the applicable laws, rules and regulations of the user’s jurisdiction.
We reserve the right to refuse, suspend or terminate your access to the cloud if we determine, in our sole discretion, that you have in any way violated these Terms or are otherwise ineligible to access or use the Cloud or Services. If your actions are determined by us to violate these Terms, We may, in our sole discretion, try to remediate that violation by working with you individually, but are under no obligation to do so, and if any such remediation efforts are unsuccessful (in our sole discretion), then we may revoke your rights to the Cloud.
We will use reasonable efforts to make the public Cloud available 24/7/365, but from time to time, we will have scheduled outages for maintenance purposes and other upkeep. Where feasible, we may, in our sole discretion, make efforts to inform you about any outages and report on the nature and reason for any outages that may occur in an open and transparent manner, though we are under no obligation to do so, and in any case will not be liable for any downtime.
User Generated Content
You may create or upload content whilst using the Cloud and any of its related Services. You are solely responsible for the content of, and for any harm resulting from, any content that you post, upload, link to, or otherwise make available via the Service, regardless of the form of that content. We are not responsible for any public display or misuse of your content.
We have the right to refuse or remove any User Generated Content that, in our sole discretion, violates any laws or we deem violates the terms of service or the spirit of the Cloud Community.
You retain ownership of and responsibility for Your Content. If you're posting anything you did not create yourself or do not own the rights to, you agree that you are responsible for any Content you post, that you will only submit Content that you have the right to post and that you will fully comply with any third party licenses relating to Content you post.
Because you retain ownership of and responsibility for Your Content, we need you to grant us — and other Code Snippet Cloud Users — certain legal permissions listed below. These license grants apply to Your Content. If you upload Content that already comes with a license granting us the permissions we need to run our Service, no additional license is required. You understand that you will not receive any payment for any of the rights granted in the sections below. The licenses you grant to us will end when you remove Your Content from our servers, or it is removed from the Cloud network.
We need the legal right to do things like host Your Content, publish it and share it. You grant us and our legal successors the right to store, archive, parse, and display Your Content and make incidental copies, as necessary, to provide the Service, including improving the Service over time. This license includes the right to do things like copy it to our database and make backups, show it to you and other users; parse it into a search index or otherwise analyze it on our servers, share it with other users.
Any User-Generated Content you post publicly may be viewed by others. By setting your code snippets to be viewed publicly, you agree to allow others to view and make copies, download, and use them for their own use.
If you set your pages and repositories to be viewed publicly, you grant each User of Code Snippets Cloud a nonexclusive, worldwide license to use, display, and perform Your Content through the Code Snippet Cloud Service. If you are uploading Content you did not create or own, you are responsible for ensuring that the Content you upload is licensed under terms that grant these permissions to other Code Snippet Users.
Limitation of Liability
In no event shall Code Snippets B.V. and/or its respective suppliers be liable for any special, indirect, or consequential damages, or any damages whatsoever resulting from loss of use, data, or profits, whether in an action of contract, negligence, or other tortious action, arising out of or in connection with the use or failure to provide services, or information available from the Cloud or its Services.
To the maximum extent permitted by law, Code Snippets B.V. and its affiliates shall not be liable under contract, tort, strict liability, negligence, or any other legal or equitable theory with respect to the Cloud or its Services. Any indirect, incidental, special, consequential, or punitive damages, or any loss of data, opportunities, reputation, profits, or revenues, even if Code Snippets B.V. or its affiliates have been told of the possibility of such damage, and even if these remedies fail their essential purpose. nothing in this limitation of liability shall prevent Code Snippets B.V. the right to seek and obtaining equitable relief. notwithstanding such right of equitable relief, to the extent that applicable law does not permit such a limitation of liability or exclusion of liability, such limitation will apply to the maximum extent permitted by law.
No Unlawful or Prohibited Use
As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Code Snippets server, or the network(s) connected to any Code Snippets server or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems, or networks connected to any Code Snippets server or to any of the Services through hacking, password mining, or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services. You may not attempt to copy or change, alter, or otherwise attempt to modify the Services or these Terms of Service (ToS).
Private Code Snippets
We treat the content of private snippets as confidential, and we only access it as described in our Privacy Policy—for security purposes, to assist the code owner with a support matter, to maintain the integrity of the Service, to comply with our legal obligations, if we have reason to believe the contents are in violation of the law, or with your consent.
Links to Third-party Sites
We do not allow third-party llinks to the following categories on our cloud network: Competitor websites/ apps, prohibited sites, sites promoting hateful, violent content, any site we do not approve of. Furthermore, we in our absolute and sole discretion have the right to refuse or remove any links to third party sites that we do not see as appropriate or violates any laws or we deem violates the terms of service or the spirit of the Cloud Community.
Any third party links on the cloud network will let you leave Code Snippets’ site. The linked sites are not under the control of Code Snippets B.V., and We are not responsible for the contents of any linked site or any link contained in a linked site or any changes or updates to such sites. We are not responsible for webcasting or any other form of transmission received from any linked site. We provide these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Code Snippets B.V.
